These terms and conditions govern the sale of products offered on this website by MagicWallGarden, Tax ID (CIF) 13168524N, with registered address at C/ Santa Águeda, 20 4º izq, 09003 Burgos, Spain.
The contract covers the sale of cultivation products marketed under the Magic Wall Garden brand.
All prices are displayed in euros (€) and include the applicable Value Added Tax (VAT).
Payments are processed through the secure Stripe payment gateway. Transactions are encrypted using secure security protocols.
Shipments are made under DAP (Delivered At Place) terms. The buyer is responsible for any customs duties, import taxes, or additional charges applicable in the destination country outside the European Union.
Estimated delivery times are indicative and may vary depending on the destination country or circumstances beyond reasonable control, including force majeure events.
Consumers have the right to withdraw from the purchase within fourteen (14) calendar days from receipt of the product in accordance with European regulations.
To exercise this right, the customer must notify the seller in writing at info@magicwallgarden.com.
The product must be returned in perfect condition and in its original packaging. Return shipping costs shall be borne by the buyer unless the product is defective.
Products are covered by a three (3) year legal warranty in accordance with Spanish Legislative Royal Decree 1/2007.
In the event of lack of conformity, the consumer may choose between repair, replacement, price reduction, or contract termination, as provided by law.
In accordance with Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform available at: https://ec.europa.eu/consumers/odr
This contract shall be governed by Spanish law. In the event of dispute, the parties submit to the courts and tribunals of the consumer’s domicile.
MagicWallGarden shall not be liable for indirect damages, loss of profit, loss of business opportunity, or consequential damages arising from the use of the product.
In any event, MagicWallGarden’s total liability shall be limited to the amount actually paid by the customer for the product subject to the claim, unless mandatory law provides otherwise.
Nothing in this clause limits statutory consumer rights.
MagicWallGarden shall not be liable for failure or delay in performing its obligations where such failure results from circumstances beyond its reasonable control, including but not limited to:
Obligations shall be suspended for the duration of the force majeure event.
These Terms may be available in multiple languages.
In the event of discrepancies between versions, the Spanish version shall prevail, unless mandatory applicable law provides otherwise.
